學校圖書館複印行為之相關問題研究

摘要

圖書館一直為學校的心臟，是師生仰賴汲取知識及流通資訊的主要來源。由於科技的進步，除了影響文明發展的速度，也涉及相關智慧財產權的保護。本文藉由著作權法上對於圖書館、複印、重製等定義的釐清，透過實例探討，對於圖書館之複印行為作界限上的認定，以減少校園內師生與圖書館館員們，在學校圖書館內因為複印行為而產生的糾紛，並建立尊重與維護著作權的正確觀念。

A study on legal issues asising from

copying books in school libraries

Abstract

The libraries have been the core (or heart) of the schools and the primary sources of acquiring knowledge and circulating information for all teachers and students. The progress of technology not only has impacts on the development of modern civilization but also involves in the protection of intellectual property, however.

This article tries to set a boundary on the behaviors of copy in libraries by clarifying the definition of libraries, copying, and duplication and by study of empirical cases in real world. With that, we hope to reduce the arguments between teachers/students and the librarians in campus arising from behaviors of copy and to build up the concept of respecting and protecting Law of Copy Right accordingly.
