摘 要
當代圖書館由於服務屬性的轉變，將無可避免的必須面對著作權法所帶來的衝擊。如何掌握讀者服務的公共利益與著作人的私利而謀求平衡，其核心精神便是著作權法中的合理使用原則。但基於合理使用的判斷並非易事，圖書館營運過程中所利用他人著作之行為，很難有一套明確性的標準，用於檢視其是否合於著作權法中合理使用的範疇；而必須視不同的利用行為進行個案分析，這對普遍缺乏相關法律認知的圖書館從業人員可說是一項考驗。是以，本研究擬以合理使用原則為論述核心，就圖書館傳統營運實務及數位化服務之轉化過程中，常涉及到和著作權法有關的爭議性問題進行探究，以期能建構出基本的運作規範，做為圖書館營運與管理時之參考。

Abstract
Due to change of service function, library needs to face the impact of new copyright regulation. How to balance between public benefits of readers and private benefits of authors is a key issue. The solution is the principle of reasonable uses which is core spirit of copyright law. But it is difficult to judge or follow the fair use principle in practice. Therefore, this principle would examine case by case. At the same time, this is a challenge for staffs in library, because staffs do not have enough related knowledge of copyright law. This purpose of paper is focus on the principle of fair use to discuss and investigate the related copyright problems in library. The contribution of this study may build basic operational processes to be a reference of operation and management in library.
