論近代人權思想之發展趨勢

摘 要
本文擬藉由近代人權思想形成之背景與原因，以及近代人權思想形成之理論基礎，來深入瞭解近代人權思想的發展趨勢。最初，十六、十七世紀第一代的人權以公民的政治權利為主，期間經過了第二代、第三代人權，發展到現在二十一世紀的第四代人權，也就是所謂的新興人權，包括了社會權、環境權、抵抗權、隱私權、知的權利、人格權、和平權。現今第四代人權的觀念是動態的、發展的，且具時代性意義的。

Summary
Human rights thought is neither the product in modern times, nor the bourgeois phenomenon of bourgeoisie, it can be derived from the human being. Human rights are not also the unvarying rights ,it may fill constantly with the development of human society.
We can deeply understand the development of the modern human rights thought by the background and cause of the modern human rights thought grown up and its theory foundation.
In the beginning, the first-generation human rights are the civil political rights in the 16-17th. Afterward, the second-generation and the third-generation human rights passed.
Now, it develops into the forth-generation human rights in the 20th,is so-called the emerging human rights, including the social rights ,environmental rights, resistant rights, private rights, the right to know, personality rights, peace rights .The forth-generation human rights are dynamic, developing and epochal meaning.
